What is a reasonable accommodation?
A reasonable accommodation is a modification or adjustment to a job, workplace, or educational environment that allows people with disabilities to participate on equal footing. In Utah, reasonable accommodation is required under the Americans with Disabilities Act (ADA), which is a federal law that prohibits employers from discriminating against qualified individuals with disabilities. The type of reasonable accommodation provided may vary depending on the particular situation and the needs of the individual. Generally, it may include changes to the job application process, job duties or physical workspace, or making special equipment or services available. For example, an employer may provide a ramp to provide access to a building or provide a specialized computer for an employee with low vision. Reasonable accommodation should not create an undue hardship for an employer. Generally, an undue hardship is an action that requires significant difficulty or expense when compared to the size and resources of the employer. It is important to note that employers are not required to provide accommodations that are not reasonable, cause an undue financial or administrative burden, or pose a direct threat to the health or safety of others. At the end of the day, employers should be flexible in providing reasonable accommodation to those with disabilities. Ultimately, providing accommodations helps ensure that everyone in the workplace is treated with the dignity and respect they deserve.
