What is an interactive process?

An interactive process is a process that takes place between an employer and employee when the employee has a disability. The process is intended to discuss how the employer can make reasonable accommodations to the employee’s condition so that they can do their job. In Florida, employers are required to go through the interactive process to accommodate a disabled employee, as well as comply with the Americans with Disabilities Act and Title I of the Americans with Disabilities Amendments Act. The interactive process begins with the employer assessing the employee’s abilities and discussing the potential accommodations. There is a lot of communication during this process, as the two sides work together to come up with a plan that works best for them. The employer and employee should discuss the options that are available to them, such as modified job duties, alternative work schedules, assistive technology, and/or physical or structural changes to the workspace. Once the plan has been agreed upon, the employer and employee should document it in an agreement that is signed by both parties. This will ensure that the employee’s rights are protected and that the employer can be held accountable for honoring the accommodations. In Florida, all employers are expected to be mindful and understanding of the needs of disabled employees, and the interactive process is a way for them to do that. It allows both parties to communicate and work together to find a successful solution that benefits everyone.
