What is the process for filing a disability discrimination complaint?
If you believe that you have been discriminated against in Massachusetts based on your disability, you may file a complaint of disability discrimination with the Massachusetts Commission Against Discrimination (MCAD). The process starts by submitting a written complaint form to the MCAD. You must file the complaint within 300 days of the alleged discrimination. When completing your complaint form, you must provide information such as identifying the employer, detailing the discrimination that has occurred, and showing that you have been damaged because of the discrimination. It is important to provide as much detail as possible. Once the complaint is received, it will be assigned to an investigator who will assess the case. The investigator will usually contact the accused employer and ask for more details about the allegations. Depending on the situation, the investigator may also contact other witnesses and obtain additional documents. The investigation may take several months to complete. Once the investigation is finished, the investigator will present their findings to the commissioners. If the commission finds that discrimination did occur, it can order the employer to take corrective action. The commission may also award damages to the complainant if appropriate. The MCAD provides a variety of resources to assist individuals filing a disability discrimination complaint. Assistance may include free legal advice or help with submitting the proper paperwork. If you believe that disability discrimination has occurred, it is important to file a complaint as soon as possible.
