What is the reasonable accommodation process?
Under South Carolina disability law, the reasonable accommodation process is a set of steps that employers must take when an employee or job applicant with a disability needs adjustments to their work environment. The process requires employers to make reasonable accommodations to the individual’s physical or mental limitations, where those changes won’t impose an undue hardship. When an employee or job applicant makes a request for a reasonable accommodation, the employer must engage in an interactive process with the employee or applicant to determine which accommodations are available. The employer must document the process and consider all the accommodations that were requested and discussed. The employer must make reasonable accommodations that don’t create an undue hardship. An example of reasonable accommodation is making changes to the workplace environment, such as providing a desk and chair that are wheelchair-accessible. The employer may also need to provide additional training or modified job duties to accommodate the individual’s disability. If an employer fails to provide reasonable accommodations, they could be subject to legal action. South Carolina disability law requires employers to make reasonable accommodations and they can face severe penalties if they don’t comply.
