What is a child custody evaluation?
A child custody evaluation is a process used to evaluate the living circumstances for a child between two divorcing or separating parents. The evaluation process usually involves a number of professionals, including psychologists, family counselors, and attorneys to examine the living environment of the child. The purpose of the evaluation is to determine the best interest of the child, including the physical and emotional well-being of the child. In West Virginia, the court may order a child custody evaluation if the court determines that an evaluation would be in the best interest of the child. The court will evaluate information taken from interviews, records, background checks, and home visits. The court is looking for certain factors when reviewing the information gathered during the evaluation such as the relationship between the parents and the parent’s ability to provide a safe and secure environment for the child. The results of the evaluation will determine the court’s decision regarding custody and visitation. Ultimately, the court will use the evaluation results to make a decision on what type of arrangement best serves the needs of the child. The court may also consider other important factors such as the child’s relationship with other family members and any evidence that the parents are able to cooperatively co-parent. The court may also order a parenting plan that establishes the rights and responsibilities of each parent.
