What is a post-divorce modification?
A post-divorce modification is a change to a court-ordered divorce agreement or decree made after the divorce has been finalized. In Arizona, post-divorce modifications can be made when it comes to parenting time, legal decision-making, payment of spousal maintenance, or child support. These modifications are usually made when one or both of the involved parties experience a significant change in their circumstances, such as a change in employment or new financial obligations. In order to modify an existing divorce agreement, both parties must agree to the change. If they cannot come to an agreement, one party can file a motion with the court for the modification, and the court will then consider the motion and make a decision as to whether to modify the agreement or not. When a court has to make a decision on a post-divorce modification, they will consider a variety of factors, such as the best interests of the children, the length of time since the divorce was finalized, the change in circumstances of the involved parties, and any other relevant information. If the court does decide to modify an existing agreement, they will draw up an order reflecting the changes and both parties must abide by this new agreement. Any changes made to an existing agreement are usually permanent unless changed by a court order.
