Can a divorce be overturned?
In Indiana, a divorce can only be overturned in very rare cases. This is known as an “appeal.” The process of appealing a divorce is very complicated and difficult. Generally, an appeal can be made if there is clear evidence that the court made a mistake or was unjust in its decision. In Indiana, an appeal must be filed within thirty days of the divorce decree being entered. In a divorce case, the court’s decision is typically final. This means that the court’s decision is binding and can’t be overturned by either party. The court does not have the authority to change its decision unless it has made an error. Even if a party is able to file an appeal, the court will only overturn the decision if it finds that the court was wrong to begin with. In certain circumstances, a party may be able to have a divorce “reopened.” This may happen if a divorce was finalized based on a unilateral mistake, such as if a party was unaware of certain facts or signed documents without knowing the full implications. The party can then request that the divorce be reopened so that they can present additional evidence and facts that were not presented to the court during the divorce proceedings. Overall, a divorce can be overturned in very rare cases. It is important to note that the chances of a successful appeal are very slim and the process is expensive and time consuming. It is for this reason that it is best to ensure that the divorce proceedings are done correctly from the outset, to avoid having to potentially file an appeal.
