What is a child support modification?

Child support modification is a legal process in Maryland that allows for a parent to have their court ordered child support payments changed. This process works when either the paying parent or the receiving parent can prove that the current child support arrangement is no longer feasible, due to a change in circumstances. A change in circumstances could include a significant decrease or increase in income, the birth of an additional child, or the start of college. When a parent is seeking a modification, they must file a petition with the Maryland court. The court will then review the petition to decide if a modification should be granted. If the court determines that a modification is appropriate, they will issue an order of modification that outlines the new child support amount. It is important to note that the court must consider the needs of the child or children first in determining if a modification should be granted and how much the new payment should be. Once the order of modification is given, the paying parent must follow the new amount and comply with the court’s order. If the paying parent fails to do so, they will be subject to civil enforcement, such as wage garnishment, liens, and other legal consequences. Both parties must abide by the court’s order or face legal consequences.
