How is a landlord liable for a tenant's dog bite?

In the state of Washington, landlords can be held liable for a tenant’s dog bite if they knew or should have known of the dangerous behavior exhibited by the dog prior to the bite, and had ample opportunity to take steps to prevent the injury. This is known as the “one bite rule.” Washington also has a “strict liability” law, which applies when the owner of the dog has knowledge that the dog has displayed dangerous behavior, or if the owner intentionally or negligently allows the dangerous behavior to occur. In these cases, the landlord may be held liable for any resulting injuries without having to prove negligence. In addition, if a landlord leases a property to a tenant with a dog or allows a tenant’s dog to remain on the property after a bite has occurred, they may also be held responsible for any damages caused by the dog. In short, Washington landlords can be held liable for a tenant’s dog bite if they have knowledge of the dog’s dangerous behavior prior to the bite or if they allow a known dangerous dog to remain on their property after a bite has occurred. They may also be liable if they intentionally or negligently allow the dangerous behavior to occur, or if they lease the property to a tenant with a dog.
