What is the process of filing a restraining order?

In Alaska, the process of filing a restraining order begins with preparing a petition for an Order for Protection. The filer must be willing to answer questions about the nature of the abuse, provide information about the parties involved, and prove that the filer is in imminent danger of domestic violence. Once the Order for Protection is filed, the opposing party must be served with the Order. Service can be completed by an officer of the court, a private process server, or by mail. Once the opposing party is served, a hearing will be scheduled to determine whether a restraining order should be granted. At the hearing, the petitioner, who is the person filing the restraining order, must make their case as to why a restraining order should be granted. The respondent, who is the person being served, will have an opportunity to give their side of the story. The court will make a decision based on all the evidence presented. If the court grants the Order for Protection, the respondent must comply with the order to not contact, threaten, or harm the petitioner.
