Yes, in New York, there are laws that protect victims of dating violence. The New York State Domestic Violence Law defines dating violence as a “particular type of domestic violence” that consists of inflicting physical harm or the threat of physical harm on someone with whom the abuser is in, or was previously in, a dating relationship. The Domestic Violence Law acknowledges that victims of dating violence may need additional assistance with a variety of issues, including protection from an abuser. As such, the Law allows the victim–or their parent or guardian if the victim is a minor–to seek a court-ordered “order of protection” from an abuser. An order of protection is a court order that is designed to protect victims from further abuse and harassment. It can include provisions for the abuser to stay away from the victim, as well as any other provisions necessary to protect the victim. In addition to seeking an order of protection, victims of dating violence may also be eligible for other legal remedies, including assistance with filing for a divorce, sponsorship of a victim’s immigration status, legal aid for families in crisis, or assistance with obtaining public assistance. By providing legal safeguards for victims of dating violence, New York is helping to ensure that all victims in the state can live free from fear of physical and psychological harm.
