What are the elements of a products liability claim?
A products liability claim is a type of personal injury claim related to a faulty product that caused injury to an individual. In Indiana, a person must prove four elements to have a successful products liability claim. The first element is that the product must be defective. In other words, the product must have been manufactured, designed, or marketed in a way that proves to be defective or dangerous. The second element is causation. This means that the product must have caused the injury or damage. It must be proven that the defective product was the direct cause of the injury or damage. The third element involves damages. The claimant must prove that the injury caused some kind of damage, such as physical, emotional, or economic. This can include medical bills, lost wages, or other financial losses. The fourth and final element is a connection to the defendant. The claimant must prove that there was a connection between the manufacturer, seller, or other party and the product that caused the injury. These four elements are necessary for a successful products liability claim in Indiana. If a person is injured by a defective product, they may have the right to seek compensation for their injuries. To do so, they must be able to prove all four of these elements.
