How do I apply for a Guardianship?

If you are looking to apply for guardianship of an individual with a disability in Texas, there are a few steps you will need to take. First, you will need to obtain an application from the Texas probate court or district court in the county in which the individual you are applying for is located. The application is called an Application for Guardianship of Disabled Person. You will need to file the completed application, your identification, and any relevant background information with the court. Second, if required by the court, you will need to appear in court in order to have an informal hearing. The purpose of this hearing is to determine your fitness for guardianship. During this hearing, the judge may ask you questions regarding your background and the care that you will provide for the individual in need of guardianship. Third, after the hearing is completed, the court will enter an order appointing you as the guardian. The order will specify the scope of your authority, the duties you will need to perform, and any special conditions you will need to observe. Finally, you will need to be able to provide proof of guardianship. This is done by filing a certification with the court and providing proof of identity. Once the court has accepted your proof, you will be appointed as the guardian for the individual. Once all of these steps have been completed, you will officially be appointed as the guardian of the individual in Texas.
