How does the Social Security Administration (SSA) determine disability?
The Social Security Administration (SSA) determines disability by establishing a set of rules and regulations that are used to evaluate the severity of an individual’s medical condition. The SSA considers the impact of a person’s impairment or combination of impairments on the ability to work. The SSA evaluates an individual’s disability by assessing the individual’s ability to do basic functions such as seeing, hearing, walking, concentrating, and remembering. Additionally, the SSA considers any medical treatment an individual has received, as well as their medical history. The SSA generally requires objective medical evidence from an individual’s doctor to make a determination of disability. This evidence must include a description of the individual’s diagnosis, the treatment they have received, and their response to treatment. In North Dakota, the SSA will also consider any non-medical circumstances such as age, educational background, previous work experience and skills, and physical and mental limitations. In order to qualify for disability benefits, an individual must be unable to work for at least 12 months due to their disability. If an individual can prove that they are unable to work due to their disability, then they may be eligible for benefits. North Dakota’s Disability Planning Law is designed to ensure that anyone who is considered legally disabled is given the assistance they need to survive financially.
