What is a living will?
A living will is a type of document that outlines the wishes of an individual regarding medical treatments and end-of-life care in the event that they become too ill to make decisions for themselves. The purpose of a living will is to ensure that an individual’s wishes are respected and carried out even if they cannot speak for themselves. This type of document is part of a larger estate plan, and in North Dakota, it is known as an advance health care directive. Advances health care directives in North Dakota can include a living will as well as other documents such as a health care power of attorney, which allows an individual to name someone else to make medical decisions for them if they cannot. The living will specifically outlines the types of treatments, life support, and end-of-life care that an individual does or does not want to receive. By creating this type of document, it can help to alleviate the burden of making difficult decisions from loved ones or medical professionals, as well as provide assurance that individual’s wishes will be respected. It is important to discuss these documents and wishes with loved ones or health care providers before creating the document. In North Dakota, a living will should be written and signed in accordance with state laws, and then witnessed by at least two other people.
