What is a DUI/DWI?
A DUI/DWI (Driving Under the Influence/Driving While Intoxicated) is a criminal offense in Virginia. It means a person has operated a motor vehicle while having a blood alcohol concentration (BAC) of 0.08 or greater, or while under the influence of drugs or alcohol that impairs their ability to drive safely. A person can also be charged with a DUI/DWI if they are found to be operating a motor vehicle while under the influence of a combination of drugs and alcohol. In Virginia, the penalties for a DUI/DWI conviction depend on the specific facts of the case. A first offense could result in a fine, license suspension, and mandatory alcohol and/or drug use treatment. A second offense can lead to a jail sentence of up to one year, a more substantial fine, and a longer license suspension. In addition, if someone is convicted of three DUI/DWIs within ten years, they will be charged with a felony and face more severe penalties. Apart from criminal penalties, a DUI/DWI conviction can also have other legal consequences. In some cases, a person may lose their job or professional license, and their auto insurance rates could go up significantly. In addition, many DUI/DWI offenders are required to attend Alcohol Safety Action Program classes, which are educational sessions designed to help drivers make better decisions when behind the wheel.
