What are the different types of DUI charges?
In Texas, there are three types of DUI charges: driving while intoxicated (DWI), driving under the influence – drugs (DUI-Drugs), and boating while intoxicated (BWI). Driving while intoxicated (DWI) is a criminal charge that occurs when a person drives a motor vehicle while having a Blood Alcohol Concentration (BAC) of 0.08 or higher, as measured by a Breathalyzer or blood test. A person with this charge can face a Class A Misdemeanor, which carries a fine of up to $4,000, a county jail sentence of up to one year, and license suspension up to two years. Boating while intoxicated (BWI) is a criminal charge when a person operates a boat while having a BAC of 0.08 or higher. This is a Class B Misdemeanor and it has the same punishment as DWI with a fine of up to $2,000, 180 days in county jail, and a license suspension up to two years.
