Are there any alternatives to jail time for a DUI?
In Washington, a person convicted of driving under the influence (DUI) may face jail time. However, there are several alternatives to jail time that are available to those charged with DUI. One such alternative is a suspended sentence. In this arrangement, a judge will sentence the offender and then suspend the sentence, allowing the offender to remain free provided they comply with the conditions set forth by the court. These conditions may include drug or alcohol treatment, community service, or a period of probation or parole. Another alternative to jail time is a stay-at-home order. This requires the offender to remain at home and not drive for a specified period of time. The offender may be designated an “ignition interlock device” (IID) on their vehicle, which will prevent them from driving if their blood alcohol concentration (BAC) is above the legal threshold. Finally, offenders may be required to undergo an alcohol or drug assessment, and/or enter into a diversion program such as drug court, alcohol court, or DWI court. These programs allow offenders to receive treatment in lieu of jail time. Although jail time is possible for those convicted of DUI, there are alternatives to incarceration available in Washington.
