What happens when a DUI results in an accident?
In Minnesota, when a DUI results in an accident, the penalties for the DUI charge can increase significantly. This is based on the severity of the accident. For example, if the accident results in serious bodily injury to another person, the charge could become a felony DUI, which carries a maximum of three years in prison and/or a fine of up to $14,000. If a death occurs, the charge could be elevated to criminal vehicular homicide which carries a maximum fine of $40,000 and/or a maximum of 10 years in prison. In addition to the criminal charges, there is also the possibility of civil lawsuits or claims being filed against the driver that was intoxicated. These could include claims of property damage, medical bills, pain and suffering, or funeral related expenses. Lastly, depending on the severity of the accident, a civil suit could be filed to revoke or suspend the driver’s license. This would mean the driver would no longer legally be able to operate a motor vehicle. No matter the severity of the accident, a DUI resulting in an accident is a serious offense. The consequences are severe and long-lasting for both the person arrested and the victims of the accident. It is important for everyone to understand the laws and the consequences associated with a drunk driving offense.
