What is an ignition interlock violation?
An ignition interlock violation is when a person with a DUI conviction in Minnesota operates a motor vehicle with an ignition interlock device that has been tampered with, circumvented, or is not functioning properly. Under Minnesota law, any person who has been convicted of Driving Under the Influence (DUI) may be ordered to install an ignition interlock device in any vehicle they operate. The interlock device is a breathalyzer that requires the driver to provide a breath sample prior to operating the vehicle. If the breath test results in a blood alcohol concentration (BAC) of 0.02 or higher, the device will prevent the vehicle from starting. If the driver fails to provide a breath sample, or attempts to bypass or tamper with the device, this is known as an ignition interlock violation. The consequences for an ignition interlock violation in Minnesota can be serious. It can result in fines up to $3,000 and/or a jail sentence of up to one year. Additionally, the driver’s license can be suspended for a minimum of six months and up to two years. Furthermore, the violation can be used to revoke or modify any existing court sentence, such as extending the period of probation or increasing the sentence of any imposed jail time.
