Can I get an expungement for a DUI conviction?

In Washington, you may be able to get an expungement for a DUI conviction depending on the type of conviction you have. Generally, for those convicted of DUI, you can apply for an expungement if you have no further convictions for a period of five years from the conviction date. However, if you have been convicted of a more serious offense such as Vehicular Homicide or Vehicular Assault, you will not be eligible for an expungement. In addition to being a period of five years, to be eligible for an expungement, you must also have paid any applicable fines or served any jail or prison time that were imposed by the court. Additionally, you must have completed any court-ordered alcohol or drug treatment programs or courses the court dictated. Once you have met all of the above requirements, you can then file a petition with the court to have your DUI conviction expunged. At this point, the court will review your petition and decide whether or not to grant the expungement. If granted, your DUI conviction will be wiped from your criminal record and you will once again be treated as if you have no criminal history.
