What type of license suspension is required for a conviction of a DUI?

In California, a conviction for driving under the influence (DUI) results in suspension of the offender’s driver’s license. The length of the suspension period depends on the specific circumstances. A first-time DUI conviction results in a six-month license suspension, plus any additional time that the judge deems appropriate. The suspension period can be longer if the offender had an excessive amount of alcohol in their system, drove recklessly, or was found to be responsible for an accident that caused injury or death. Subsequent DUIs result in a one-year license suspension or longer if the judge orders it, including reinstatement after a two- or three-year period for a fourth or subsequent DUI conviction. The court may also require the offender to use an Ignition Interlock Device (IID), which requires the driver to pass an alcohol test before starting their vehicle. If the offender is under the age of 21, the license suspension is one year or three years if there is a fourth or subsequent DUI conviction. The court may also suspend the driver’s vehicle registration and require them to obtain an SR-22 certificate, an insurance document defining the insurance coverage the offender needs to cover their legal liability. In addition, all DUI offenders must complete a DUI program approved by the California Department of Motor Vehicles (DMV) before their license can be reinstated. The program can take up to nine months.
