What type of license suspension is required for a conviction of a DUI?
In South Carolina, a conviction of a DUI (Driving Under the Influence) can result in a license suspension. Depending on the circumstances, the length of the suspension can vary. For a first-time offender, the license suspension can be as short as 30 days. However, if the DUI involves aggravating factors such as a higher-than-legal BAC or minors in the vehicle, the suspension can be as long as six months. If the offender’s blood alcohol content (BAC) is at least 0.16 or if the offender refuses a chemical test, the suspension can be as long as one year. The suspension can also be enhanced to two years if the offense was committed while an Ignition Interlock Device was installed on the vehicle, or if the offender has a previous DUI conviction. If the offender is convicted of a second DUI, the license suspension is automatically a year. Third and subsequent DUI convictions can result in a license suspension of up to five years. In all cases, the offender may be required to fulfill other driving-related requirements issued by the court, including taking a driving safety course, installing an Ignition Interlock Device, or attending alcohol/substance abuse treatment.
