What is the difference between a DUI and a DWI in the state of North Carolina?

In the state of Minnesota, the difference between a DUI and a DWI is that DUI stands for Driving Under the Influence and DWI stands for Driving While Intoxicated. A DUI applies to people under the legal drinking age of 21 that are caught driving with any detectable amount of alcohol in their system. A DWI applies to drivers of any age that are found to have a blood alcohol concentration (BAC) of 0.08 or higher. In Minnesota, a DUI is considered a gross misdemeanor and carries a maximum sentence of one year in jail and/or a $3,000 fine. It also includes license suspension or cancellation, two years of probation, and mandatory attendance of an alcohol education or treatment program. A DWI is considered a misdemeanor, carries a maximum sentence of 90 days in jail and/or a $1,000 fine, and can include license suspension for up to 90 days, up to two years of probation, and mandatory attendance of a DWI education program. In the state of North Carolina, the terms DUI and DWI are used interchangeably. However, they are similar to those in Minnesota. Both are considered misdemeanors and carry a maximum sentence of two years in jail and/or a $4,000 fine. Incarceration, license suspension, probation, and rehabilitation programs are all possible punishments that can be imposed upon conviction.
