Can I expunge a DUI conviction from my record?

In South Dakota, expungement of a DUI conviction is possible, but there are certain criteria that must be met in order for the court to consider it. The individual must have had at least five years elapse since the conviction, must not have had any new criminal convictions, and must have completed any sentence or financial obligation imposed by the court. Additionally, the individual must never have had a prior conviction for driving under the influence, and must have been arrested for a DUI in South Dakota. The laws surrounding the expungement of a DUI conviction in South Dakota can be complex and it is highly recommended that the individual seek the advice of an attorney if they wish to pursue expungement. In addition to completing the criteria above for expungement, if the individual wishes to have their DUI conviction sealed, they must have been arrested in South Dakota and must pass a background and criminal record check. If the individual is found to have a criminal record, the conviction will not be sealed. If the individual is successful in having the DUI conviction expunged or sealed, the conviction will be erased from their criminal record. However, it should be noted that the conviction will still appear on the individual’s driving record. As a result, the individual may still be subject to higher insurance premiums or other restrictions.
