What is the difference between a DUI and a DWI in the state of Arkansas?

In South Carolina, the difference between a DUI (Driving Under the Influence) and a DWI (Driving While Impaired) is the amount of alcohol that a person has in their system at the time of driving. If the blood alcohol concentration (BAC) is .08% or higher, a person can be charged with DUI. On the other hand, a DWI charge is issued if a person’s BAC is below .08%, but they can still be impaired or incapacitated due to drugs or alcohol and therefore engage in dangerous driving behavior. A DUI carries more serious consequences than a DWI, including a longer license suspension, fines, and jail time. In South Carolina, a first-time DUI offense can result in up to 30 days in jail, a $400 fine, and a 6-month license suspension. Additionally, if the BAC is .15% or higher, a first-time DUI offense carries 6 months in jail, a $2,000 fine, and a 1-year license suspension. A DWI, on the other hand, is generally charged as a misdemeanor. Punishable consequences include up to 30 days in jail, a $500 fine, and a 6-month license suspension. The takeaway is that no matter what the BAC, it is illegal to drive impaired in South Carolina. If a person does so, they will be charged either with a DUI or a DWI, depending on the amount of alcohol or drugs in their system.
