What is the difference between a drug DUI and an alcohol DUI?
In Florida, a DUI, or Driving Under the Influence, is a serious offense. A DUI may involve drugs, alcohol, or a combination of both. It is important to understand the difference between a drug DUI and an alcohol DUI. Drug DUIs are when a person drives under the influence of drugs, such as marijuana, cocaine, or other illegal drugs. The penalties for a drug DUI are the same as an alcohol DUI. A first time drug DUI offender may face up to six months in jail, up to $1,000 in fines, and a one-year suspension of their driver’s license. An alcohol DUI is when a person drives under the influence of alcohol. This is measured through a breath test and the legal blood alcohol limit for Florida is a BAC of .08%. The penalties for an alcohol DUI are more severe than a drug DUI. A first time offender may face up to nine months in jail, up to $2,500 in fines, license revocation for up to a year, community service, and court-ordered substance abuse treatment. Therefore, there is a major difference between alcohol and drug DUIs in Florida. While both offenses are serious, alcohol DUIs are more severely punished due to the higher risk of harm an individual driving under the influence of alcohol can cause.
