What is the difference between a DUI and a wet reckless charge?
A DUI (Driving Under the Influence) charge is a criminal offense in Pennsylvania that results from operating a motor vehicle while under the influence of alcohol or drugs. A driver convicted of a DUI can be subject to harsh penalties including fines, jail time, ignition interlock device, license suspension, and more. A wet reckless charge is a lesser offense than a DUI charge. It occurs when a person is charged with a DUI, but due to a plea agreement, the charge is reduced. In Pennsylvania, a wet reckless charge can result from a plea bargain, or it can be the charge initially brought against a driver. The main difference between a DUI and a wet reckless charge is that a wet reckless charge does not carry the same penalties as a DUI. For example, a motorist convicted of a DUI can face up to six months in jail and a $5,000 fine, license suspension, ignition interlock device installation, and up to one year probation. On the other hand, a wet reckless charge is a non-alcohol related charge, and typically these cases include a fine and a short probation period. In addition, license suspension is not mandatory with a wet reckless charge. Overall, it is important to remember that a wet reckless charge is an alternative to a DUI charge, but the best course of action is to never drink and drive in the first place. By doing this, you can avoid serious legal repercussions and potential danger to yourself and other drivers.
