What is DWI law?
DWI law is the term used for driving under the influence of alcohol or drugs in the state of California. It is a serious offense and carries with it heavy penalties if someone is convicted of it. It is illegal for someone over the age of 21 to be behind the wheel of a motor vehicle with a blood alcohol content (BAC) of 0.08 percent or higher. For drivers under the age of 21, the legal limit is zero tolerance, meaning that any detectable amount of alcohol in a breath or blood test renders a person guilty of operating a vehicle under the influence. If a driver is found guilty of a DWI, the court may impose a range of punishments, including fines, probation, driver’s license suspension, mandatory treatment programs, and even jail time. The severity of the punishment typically depends on whether it is a first-time offense, how high the BAC was, and whether there were any aggravating factors, like causing an accident or having a minor in the vehicle at the time. In addition to criminal penalties, a DUI charge may also lead to a civil suit for damages, as well as increased insurance rates. Therefore, it is important to be aware of the risks of driving under the influence. DWI laws are strictly enforced in California, and if you are caught driving while impaired, it could be a life-altering mistake.
