What happens if I violate the terms of my DWI probation?
If you violate the terms of your DWI probation in California you could face serious consequences. Depending on the severity of the violation, a judge could revoke your probation and replace it with jail time. Also, a judge could impose new terms of probation, such as house arrest, community service, or rehabilitation. If you have already served the jail time associated with your original DWI conviction, then the judge could still sentence you to more time. A probation violation can also incur additional fines, fees, and restitution. For example, if you were issued a DUI and probation violation while driving, you may be required to pay restitution to any victims of the accident. You will also be required to pay fines to the court, and any other fees that are associated with the violation of probation. Finally, if you fail to comply with the terms of your probation the judge may issue a warrant for your arrest. If you are arrested your DWI probation officer will be notified and will investigate your violation. The probation officer will then make a recommendation to the judge on how to proceed, which could include jail time or other sanctions.
