What is DWI law?
DWI law, or Driving While Intoxicated, refers to laws in Virginia that prohibit operating a motor vehicle while under the influence of alcohol and/or drugs. In Virginia, it is illegal for any person over the age of 21 to drive a vehicle with a BAC (blood alcohol content) of .08 or higher. It is illegal for an underage driver to drive a vehicle with any measurable amount of alcohol in their blood. In Virginia, DWI may be charged as a misdemeanor or felony, depending upon the severity of the offense. A first time offender may be charged with a misdemeanor DWI, which is punishable by up to one year in jail, a fine up to $2,500, and/or suspension of the defendant’s driver’s license. If a person is convicted of a felony DWI, they may be sentenced to five years in prison, a fine up to $2,500, and potential forfeiture of their driver’s license. In addition to the possibility of criminal penalties, a person convicted of DWI in Virginia may face administrative penalties. This may include the suspension or revocation of their driver’s license and the requirement to install an ignition interlock device on their vehicle.
