What is the difference between a DWI and a DUI?
In Arkansas, a DWI stands for “Driving While Intoxicated” and a DUI stands for “Driving Under the Influence”. Although both are serious violations, there is a distinct difference between them that must be understood. A DWI is a more serious offense that involves driving with a Blood Alcohol Concentration (BAC) over the legal limit. This means that a person was driving while impaired by alcohol or drugs. In most states, a DWI conviction carries serious penalties, including possible jail time and a suspension of your driver’s license. A DUI is not as serious as a DWI, but it still carries potential consequences. A DUI is defined as driving with a BAC of any level that affects a person’s ability to drive safely. This means that even though a person may have a BAC level that is below the legal limit, if it is enough to impair their driving, they can still face potential charges. Depending on the circumstances, a DUI can still carry a jail sentence and the suspension of a driver’s license. In Arkansas, it is illegal to drive with a BAC above .08. It is important to always be aware of your alcohol consumption and never get behind the wheel if you are impaired. The consequences of a DWI or DUI can be severe and can greatly affect your life.
