What should I expect during a DWI trial?
If you are charged with a Driving While Intoxicated (DWI) offense in California, you should expect to appear in court for a trial before a judge. During the trial, the prosecutor will present evidence that you were driving and impaired in some way. This may include eyewitness testimony from police officers or other witnesses, blood alcohol test results, videos or other evidence. The prosecutor may then call on you to make a statement to the court. This is your opportunity to tell your side of the story and explain any extenuating circumstances. During the trial, the judge or jury will decide if the evidence presented proves beyond a reasonable doubt that you were driving under the influence. If the judge or jury decides that the evidence is not sufficient, then the prosecutor must prove beyond a reasonable doubt that you are guilty. If the judge or jury decides you are guilty, the defense attorney may make a motion for a sentence recommendation. After listening to the defense’s recommendation, the judge will issue a sentence according to California law. The sentence may include fines, probation, community service, and even jail time. It is important to remember that you have the right to an attorney and are entitled to a fair trial. A skilled attorney can often identify weaknesses in the prosecution’s case, and help ensure your rights are respected throughout the process.
