What types of evidence will be used against me in a DWI case?

In Nebraska, evidence used against you in a Driving While Intoxicated (DWI) case can include both physical and circumstantial evidence. Physical evidence could include things such as the results of a breathalyzer test or a blood test, showing that your blood alcohol content (BAC) was over the legal limit at the time of your arrest. Additionally, your driving pattern, field sobriety tests, your behavior at the scene of the arrest, and police reports may all be used to build a circumstantial case against you. In some cases, video or audio recordings of the events leading up to your DWI arrest may be introduced as evidence. Additionally, testimony from any witnesses who observed your behavior up to or during the time of your arrest may be used as evidence that you were intoxicated. It can also be used to show that you were not following the rules of the road, as required by law. Finally, if you have been arrested for DWI in the past, the court may consider that as evidence in your current case. For example, if it is proven that you have been convicted of a DWI charge in the past and have sompletely ignored the terms of your probation, the court may consider that as a sign that you have proven yourself to be a repeat offender of Nebraska DWI laws.
