What is the Age Discrimination in Employment Act (ADEA)?
The Age Discrimination in Employment Act (ADEA) is a federal law that protects people against discrimination in the workplace on the basis of age. This law applies to employers with 20 or more employees and provides protection for people aged 40 or older. Under the ADEA, employers are prohibited from discriminating based on age against employees or applicants. This means that employers cannot refuse to hire someone because of their age, or treat them differently in any way – such as in terms of pay, benefits, work assignments, or other conditions of employment. Employers are also prohibited from using age as a factor in making decisions related to hiring, firing, layoffs, or any other employment decisions. The ADEA also applies to job postings, advertisements, and other forms of recruitment. Employers are not allowed to advertise stating that only employees of a certain age are considered for positions, and must provide equal opportunities for all age groups. In Florida, the ADEA is enforced by the Equal Employment Opportunity Commission (EEOC), which investigates and handles complaints of age discrimination. Individuals can file a complaint with the EEOC if they believe they have been the victim of age discrimination.
