Yes, it is illegal for employers to discriminate against employees who have disabilities in Tennessee. According to the Tennessee Human Rights Act, employers cannot discriminate against individuals based on a disability when making decisions about hiring, firing, promotion, or other terms and conditions of employment. Employers are also required to make reasonable accommodations for employees with disabilities as long as the accommodations do not impose an undue hardship on the business. Examples of reasonable accommodations may include providing a special work area for an employee who is new to the job, allowing an employee to telework, or providing modified equipment for an employee. Furthermore, employers with more than 15 employees are not allowed to ask questions about an applicant’s disability during the interview or training process. Employers may only seek information related to the applicant’s ability to perform job duties or to assess the effectiveness of the reasonable accommodation requested. If an employer discriminates against an applicant or employee because of a disability, the individual may file a complaint with the Tennessee Human Rights Commission. The Commission will investigate the allegations and determine whether discrimination has occurred. If discrimination is found, the employer may be subject to fines and other remedies.
