What are the differences between discrimination in hiring and discrimination in the workplace?
Discrimination in hiring and discrimination in the workplace both involve treating people unfairly due to their race, religion, national origin, gender, age, disability, or other protected status. However, there are important differences between the two. Discrimination in hiring occurs when an employer refuses to consider an applicant or denies an applicant an opportunity to work because of the applicant’s protected status. This can occur at any point during the hiring process, including recruiting, interviewing, or making a job offer. Discrimination in the workplace occurs when an employer treats an employee or group of employees differently than other employees because of their protected status. This can include hiring, firing, promotions, pay, job assignments, and training opportunities. Discrimination in the workplace can also include comments or actions that create a hostile work environment for an employee. In Pennsylvania, it is illegal for an employer to discriminate against an applicant or employee because of their protected status. Employees who believe they have been discriminated against can file a complaint with the Pennsylvania Human Relations Commission.
