What is the Individuals with Disabilities Education Act?
The Individuals with Disabilities Education Act (IDEA) is a law created in 1975 that provides for fair access to education for all students, regardless of their disability or need. This law is an amendment to the Education for All Handicapped Children Act, and is a federal law that requires public schools to make sure all children with disabilities are provided with a free, appropriate public education that meets their individual needs. In North Carolina, the IDEA requires public schools to create Individualized Education Programs (IEPs) for all students with disabilities. Each IEP is designed to meet the individual needs of the student and should state the student’s learning goals and objectives. This plan must be reviewed and updated on an annual basis to reflect the student’s changing needs and progress. The IEP can also be updated more often, if needed. This includes providing qualified, trained special-education teachers and support staff, as well as evaluation and placement decisions. The IDEA also ensures that students with disabilities have the same access and opportunities as their peers, and are not limited in any way. It also gives parents the right to be involved in their child’s education and ensures that their child is receiving the best possible education.
