What is the law on school prayer?
In Oklahoma, the law on school prayer is largely based on the 2002 U.S. Supreme Court ruling in the case of Santa Fe Independent School District v. Doe. This ruling determined that public school-led or school-sponsored prayer in an educational setting violates the Establishment Clause of the First Amendment to the U.S. Constitution. The Supreme Court ruling determined that public schools may not lead or sponsor prayer or any other form of religious activity. This applies to all forms of religious worship, including prayer, Bible readings, and other religious activities in classes and assemblies. The Supreme Court’s ruling does not prohibit students from participating in voluntary prayer or religious activities. Schools may not prohibit student-initiated prayer or other religious activities, provided that these activities are private and do not create a disruption in the classroom or school. In addition, the Supreme Court’s decision does not prohibit student religious clubs from meeting on school grounds before or after school. The Supreme Court has determined that these clubs have a right to equal access to school resources, just like any other student club. However, the school may not endorse or sponsor religious activities or give preferential treatment to religious clubs. Overall, it is important for schools in Oklahoma to be mindful of the law on school prayer when creating school policies to ensure that the rights of students are respected and that all students feel welcome and safe in the school environment.
