What are the federal laws that affect schools?

There are several federal laws that have an impact on schools in New York. The Individuals with Disabilities Education Act (IDEA) of 2004 is a key law that ensures students with disabilities have access to free and appropriate public education in the least restrictive environment. IDEA also requires schools to provide reasonable accommodations so that those with disabilities can access and participate in the educational activities like their peers. Schools must also adhere to the Family Educational Rights and Privacy Act (FERPA) which ensures the privacy of student records and protects the rights of students and parents to access and review records. The Every Student Succeeds Act (ESSA) of 2015 further requires states to ensure that all students are making progress toward the achievement of their educational goals. ESSA also requires schools to provide equitable education opportunities, such as supplemental services for students from low-income households or those with disabilities. Additionally, the Title IX of the Education Amendments of 1972 prohibits sex discrimination in educational institutions and ensures equality of educational access and opportunity for all students regardless of sex. Finally, the American’s with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act of 1973 also protect students by prohibiting any discrimination against them because of their disabilities. These laws require that schools make reasonable modifications to provide equal access and opportunities for students with disabilities. All of these federal laws have an impact on schools in the State of New York and must be followed in order for schools to remain in compliance with the law.
