What is an employment contract?

An employment contract is a legally binding agreement between an employer and employee. It outlines the terms and conditions of the employment relationship, such as the duties of the employee and the compensation the employer will provide. In California, there are two different types of employment contracts. The first is an at-will agreement. This type of contract makes either party free to terminate the agreement at any time, for any reason, with or without notice. The other type is an express agreement, which outlines the specific terms of the employment relationship and requires both parties to abide by these terms. Express agreements are typically created when an employee is hired for a long-term position or for a highly-specialized role. They typically include job duties, salary or wages, benefits, and termination conditions. Both types of contracts must be in writing and signed by both parties in order for them to be legally binding.
