Are employers obligated to pay employees for overtime and night work?

In North Carolina employers are obligated by law to pay employees overtime and night work pay when certain circumstances are present. According to the North Carolina Wage and Hour Act, employers are required to pay overtime pay of 1.5 times the employee’s normal wages for labor of over forty hours in a workweek. This essentially means that an employee who works over forty hours in a given workweek is due overtime payment for the extra hours. In addition, employers are also required to pay an employee an additional amount of pay for any labor that happens between the hours of 11:00 PM and 6:00 AM. This pay rate is one and one-half times the employee’s regular wage rate. All of these labor laws are in place to ensure that North Carolina employees are compensated for their hard work and are not taken advantage of by their employers. It is important for employees to be aware of their rights in the workplace and to make sure that they are receiving adequate compensation for their labor. If an employer is found to be violating these laws then they may be subject to penalties from the North Carolina Department of Labor.
