What is the eminent domain process?
Eminent domain is a process used by the government to take private property for public use, usually with compensation. In California, the eminent domain process begins with an official notification from the government agency to the property owner that it intends to acquire their property. This notification will include details about the proposed project, the amount of compensation they expect to pay, and any legal steps required to complete the process. The property owner then has the opportunity to negotiate a fair amount of compensation or challenge the government’s assertion of the right to take the property. If the parties cannot reach an agreement, the government will initiate legal proceedings and establish a court date. During this hearing a judge will review both parties’ claims and determine if it is necessary for the government to acquire the property. The judge will also determine the amount of compensation the government must pay the property owner should it proceed with the eminent domain process. If the judge rules in favor of the government, the government will then record the transaction at the local county courthouse and pay the compensation amount to the property owner. Finally, the government will gain ownership of the property and be able to move forward with its public project.
