What is the difference between a public purpose and a public use?
Eminent Domain Law in California involves the government using private land for public purposes. But what’s the difference between a public purpose and a public use? Public purpose is a broader concept than public use. In California, public purpose includes activities that benefit the public such as public health, education, transportation, and public services. Public use, on the other hand, is more specific and relates to any actual use of the land. This includes activities such as constructing roads, public buildings, or providing more access to public spaces. The key difference between public purpose and public use is that public purpose is the reason why the government is taking action, while public use is the action itself. For example, a public purpose could be to provide better access to public transportation. The public use would be the actual construction of a new rail line or bus route. In California, a public purpose must be established by the government in order for it to use eminent domain to acquire private land. This means that if the government is taking private land for a public purpose, it must also prove that there is a public use for the land. The government must also be able to prove that the taking of the land is necessary, reasonable, and has no alternatives.
