What is the WARN act?

The Worker Adjustment and Retraining Notification (WARN) Act is a federal law that requires certain employers in West Virginia to provide their employees advanced notice of plant closings and mass layoffs. The WARN Act applies to employers with 100 or more employees working 20 or more cumulative hours a week, as well as public and private agencies. Employees must receive at least 60 calendar days advance written notice of the closing or mass layoff. The WARN Act also requires employers to provide their employees with certain benefits, such as additional pay or continued health care coverage after the layoff. Additionally, the WARN Act prohibits employers from discriminating against employees for filing a claim or exercising their rights under the Act. In West Virginia, workers can file a complaint with the U.S. Department of Labor or file a lawsuit against their employer if they believe the WARN Act has been violated.
