What is sexual harassment?
Sexual harassment is a form of discrimination that is illegal in West Virginia, as well as the rest of the United States. It is defined as any unwelcome verbal or physical conduct of a sexual nature which may include things like offensive comments, jokes, remarks, physical contact, and advances. It also includes behavior that is not sexual in nature but is still based on someone’s gender, such as making offensive comments about someone’s looks or clothing. There are several forms of sexual harassment, including quid pro quo, hostile environment, and third-party harassment. Quid pro quo harassment is when someone in a position of power, such as an employer or supervisor, makes job decisions based on whether someone submits to sexual favors. Hostile environment harassment is when someone makes unwelcome sexual advances that interfere with a person’s ability to do their job or makes the work environment uncomfortable and intimidating. Third-party harassment is when someone is being harassed by someone outside of their workplace, such as a customer or client. Sexual harassment can have serious and long-lasting effects on the victim, so it is important to understand the laws in West Virginia and take action if you feel you have been a victim.
