Can an employer ask for medical information from an employee?
In Washington State, an employer is allowed to ask an employee for medical information. However, there are certain limits on what information can be requested and how the information is used. Employers in the state of Washington must abide by the Washington Law Against Discrimination (WLAD), which dictates how employers can use medical information. In general, employers in Washington are not allowed to ask an employee for any medical information before a job offer or during the application process. This means that employers cannot use medical information to make a decision about whether or not to hire someone. Even after an employee has been hired, employers are not allowed to ask for medical information that is not job-related or necessary to determine if someone is able to do their job. For example, employers are not allowed to ask an employee’s doctor for their medical records or ask an employee questions about their physical or mental health. Finally, employers are not allowed to use any medical information they receive to make decisions such as decisions related to promotions, pay raises, or job assignments. Furthermore, employers must keep any medical information they receive confidential and secure. In conclusion, employers in Washington State are allowed to ask for medical information from an employee, but only if it is necessary for job-related purposes and the employer follows all laws and regulations regarding the use of medical information.
