Are employees entitled to receive paid leave?

In Texas, employees may be entitled to receive paid leave depending on the type of leave requested and the type of job they are performing. Generally speaking, employers may provide paid leave, such as vacation, sick, or holiday time, as part of an employee benefit package. Paid leave is employer-specific and thus must be negotiated between the employer and employee. Additionally, some employers may provide paid leave for certain qualifying events and situations, such as parental leave or jury duty. Under federal law, employers are not required to provide paid vacation to employees. However, Texas employers may be required to provide unpaid leave for certain types of absences. The federal Family and Medical Leave Act (FMLA) guarantees up to 12 weeks of unpaid job-protected leave to employees in certain situations, such as an illness or care for a newborn or adopted child. The Texas Workforce Commission provides a website on workplace rights and responsibilities where employers and employees can learn more about FMLA requirements as they pertain to Texas employers. Employees in Texas may also be entitled to receive paid time off (PTO) from their employers. PTO is typically a combination of vacation, sick, and holiday time that is provided to employees to assist with fulfilling their work-life balance. Whether or not an employee qualifies for PTO is often a part of the employee benefit package and must be negotiated between the employer and employee. In a nutshell, while employers in Texas may not be required to provide paid time off for their employees, some employers may offer paid leave as part of their employee benefit package. Additionally, certain job-protected unpaid leave may be provided under the FMLA.
