Are employees entitled to be paid for overtime worked?

In Virginia, employees are entitled to be paid for overtime worked. This is a Federal law, enforced by the Fair Labor Standards Act (FLSA). Under the FLSA, hours worked over 40 in a 7-day workweek are considered overtime and must be paid at one and a half times the ordinary rate. This applies to all non-exempt, or hourly, workers. Non-exempt employees must be paid for any hours worked, regardless of whether their employer had knowledge of the extra hours or not. Additionally, although employers are not necessarily required to pay overtime for holidays, they must pay overtime for holidays that fall on days when people are usually expected to work. Employers must also not ask employees to work more than 60 hours in any seven-day period. In Virginia, employers must follow the Federal law requiring overtime pay, which includes the payment of wages for any hours worked over 40 in a seven-day period. Moreover, they must also abide by the limitations set forth in the FLSA. To ensure they stay in compliance with the law, employers should keep accurate records of employee hours worked each day and make sure that overtime is paid when applicable.
