What are environmental permitting requirements?

Environmental permitting requirements refer to a set of regulations that control the activities of individuals, businesses, and other groups as they interact with the environment. In the state of New York, these regulations are largely determined by the New York State Department of Environmental Conservation (DEC). The DEC requires permits for activities relating to air quality, water quality, wetlands, marine resources, hazardous waste, and other areas. Depending on the activity, a person or business may need to obtain multiple permits. In order to obtain a permit, an applicant must provide information and documents relevant to the activity and demonstrate that the activity will meet the DEC’s standards for protecting the environment. In general, the DEC will evaluate the impacts of the activity on the environment and may require additional measures for protecting the environment. For example, if an activity will result in the emission of air pollutants, the DEC may require that the activity occur within a certain distance of sensitive areas, that certain emission control technologies be used, that records of emissions be kept, and/or that air quality be monitored. Finally, after a permit is issued, DEC may conduct periodic inspections of the activity to ensure that it is adhering to the conditions in the permit. The DEC may also revoke or modify permits at any time, if it finds that the activity is not being carried out in accordance with the permit conditions.
